Srinagar, Dec 05: The Jammu and Kashmir High Court has scheduled February 6, 2025, as the date for the final hearing in the case concerning the nomination of five MLAs by the Lieutenant Governor.
The case, filed by former Member of Legislative Council (MLC) Ravinder Sharma, was taken up on Wednesday by a Division Bench comprising Justice Sanjeev Kumar and Justice Rajesh Sekhri.
During the proceedings, Senior Supreme Court lawyer Dr. Abhishek Manu Singhvi, representing the petitioner, informed the court that no reply had been filed by the respondents to date. The bench questioned whether a reply was necessary since the matter primarily involved a question of law.
Responding to this, Tushar Mehta, senior counsel for the respondents, requested permission to file a short reply. The court granted the respondents four weeks to submit their counter affidavit, with any rejoinders to be filed thereafter. Both parties were directed to complete pleadings before the February 6 hearing,
While Dr. Singhvi and Tushar Mehta appeared virtually, the petitioner’s legal team—comprising D.K. Khajuria, S.M. Chaudhary, Advocate Anuj Mahajan, and Aayush Pangotra—was present physically in court.
Vishal Sharma, Assistant Solicitor General of India (ASGI), represented the respondents in person. The petitioner, Ravinder Sharma, who serves as the chief spokesperson for the J&K Congress, was also present during the proceedings.
The case centers on the legality of the nomination process for five MLAs and holds significant political implications for the region. The final hearing in February is expected to provide clarity on the matter.
