Srinagar, Mar 14: The Ministry of Home Affairs on Wednesday evening announced the establishment of an Unlawful Activities (Prevention) Tribunal to evaluate the legality of Jammu and Kashmir Jamaat-e-Islami.
The tribunal comprising Justice Navin Chawla, Judge of the High Court of Delhi will assess whether there is sufficient cause to declare the Jamaat-e-Islami, Jammu and Kashmir (JeI), as an unlawful association.
The decision follows the Ministry’s declaration of JeI as an unlawful association on February 28 2019 which was extended for five more years on February 27, 2024.
The Ministry of Home Affairs, in its earlier declaration, cited specific reasons for designating JeI as an unlawful association. Now, with the formation of the tribunal, a thorough and impartial examination will take place to evaluate the validity of these reasons and decide on the association’s legal standing.
A notification from Ministry of Home Affairs, a copy of which lies with Rising Kashmir reads, “Whereas, Jamaat-e-Islami, Jammu and Kashmir (Jel) has been declared unlawful association, vide notification number S.O. 924(E) dated the 27th February, 2024, published the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii)”.
Now, therefore, in exercise of powers conferred by sub-section (1) of section 5 read with sub-section (1) of section 4 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby constitutes the Unlawful Activities (Prevention) Tribunal consisting of Justice Navin Chawla, Judge, High Court of Delhi, for the purpose of adjudicating whether not there is sufficient cause for declaring the Jamaat-e-Islami, Jammu and Kashmir (Jel) as an unlawful association, it added.
