Srinagar, Feb 25: The High Court of Jammu & Kashmir and Ladakh directed Registrar, Dean Academics, Dean School of Law and Controller examination of University of Kashmir to appear in person before it on February 27 to explain their position and to show cause as to why they have failed to implement court orders.
Hearing a plea of a student seeking direction to appear in the examination of 6th Semester of the B.A.LL.B course scheduled to be held from February 04, this year, the court of Justice Mohan Lal directed the respondents to comply with the order passed by it on January 27, 2023 in letter and spirit by the next date of hearing.
Justice Lal passed the directions after counsel representing the petitioner submitted that the career of petitioner is at stake as the respondents are not allowing him to appear in the required examination and are not issuing admit card in his favor.
On January 27, the court had directed the respondents to allow the petitioner to appear in the examination of 6th Semester, BA. LLB Course scheduled to be held from 04.02.2023.
The counsel M.S Latief representing the University had submitted that the order will be implemented in letter and spirit and the petitioner will be allowed to appear in the examination of 6th Semester, BA LLB Course.
In view of the controversy involved in the petition, the court had listed the case for final adjudication as, the court noted, the career of a student is involved.
However, due to non-seriousness of University authorities towards court orders the matter is still stuck and the career of the student is in limbo due to non-compliance of court orders.
The bench noted that the respondents did not obey the order which compelled the petitioner to file a contempt plea.
“The respondents are again directed to comply the order of this Court dated 27.01.2023 in letter and spirit, as assured by Mr. M. S. Latief, learned counsel for the respondents, by the next date of hearing. In the meantime, respondent nos. 2, 3, 5 and 7 (Registrar, Dean Academics, Dean School of Law and Controller examination) shall appear in person before this Court on the next date of hearing positively showing cause as to why the order of this Court is not being implemented,” the bench said.
