Srinagar, Dec 15: In compliance with the Ministry of Home Affairs (MHA) guidelines, the Union Territory of Jammu and Kashmir on Friday empowered the Inspector(s) General of Police in Kashmir and Jammu Zones to enforce Unlawful Activities (Prevention) Act within their respective territorial jurisdictions.
The move comes in response to a series of example notifications issued by the Ministry of Home Affairs, Government of India. As per notification S.O.4348 (E) dated 5th October, 2023, issued under sub-section (1) of section (3) of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) declared the Jammu and Kashmir Democratic Freedom Party (hereafter referred to as the JKDFP), an unlawful association.
“Whereas, subsequently, the Ministry of Home Affairs, Government of India, in exercise of powers conferred by section 42 of the Unlawful Activities (Prevention) Act, 1967, vide notification S.O 4377 (E) dated 7th October, 2023, directed that all the States and Union territory administrations shall exercise the powers exercisable by the Central Government under section 7 and section 8 of the Act ibid,” it said.
The order further said that whereas, vide order No. 14017/13/2023-NI-MFO dated 7th October, of 2023, issued by the Ministry of Home Affairs, Government of India, approval of the Central Government under section 42 of the Unlawful Activities (Prevention) Act , 1967 was conveyed to all the States and the Union territory administrations, in such circumstances and under such conditions, as maybe specified in the direction, be exercised by any person subordinate to administrations, as the Town State Government or the Union territory may be.
“Now therefore the Government of Union territory of Jammu and Kashmir, with the previous approval of the Central Government, conveyed vide order No. 14017/13/2023-NI-MFO dated 7th October, 2023 issued by the Ministry of Home Affairs Government of India, hereby directs that the powers exercisable by the Union territory of Jammu and Kashmir under section 7 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) shall be exercised by the Inspector(s) General of Police, Kashmir/Jammu Zones, within their respective territorial jurisdictions.
“Further directs that the powers exercisable by the Union Territory of Jammu and Kashmir under section 8 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) shall be exercised by the Divisional Commissioner(s), Kashmir/Jammu, within their respective territorial jurisdictions,” it added.
