Jammu & Kashmir administration on Wednesday has terminated four employees including president of Doctors Association of Kashmir (DAK) for their involvement in anti-national and terror- related activities.
As per the orders issued by General Adminstration Department, the employees have been terminated by the UT administration by invoking 311 (2) (c) of the Constitution of India – which empowers it to do so without an inquiry.
Among the terminated employees include Dr. Nissar-ul-Hassan (Doctor), Ab Salam Rather (Laboratory Bearer in Higher Education department), Abdul Majeed Bhat (Constable) and Farooq Ahmad Mir (Teacher).
An order reads, “the Lieutenant Governor is satisfied after considering the facts and circumstances of the case and on the basis of the information available, that the activities of Dr. Nisar-Ul-Hassan, Assistant Professor (Medicine), SMHS Hospital, Srinagar S/o Ghulam Hassan R/o Village Achabal, Sopore, Baramulla are such as to warrant his dismissal from service;.”
” The Lieutenant Governor is satisfied under sub-clause (c) of the proviso to clause (2) of Article 311 of the Constitution of India that in the interest of the security of the State, it is not expedient to hold an enquiry in the case of Dr. Nisar-Ul-Hassan, Assistant Professor (Medicine), SMHS Hospital, Srinagar S/o Ghulam Hassan R/o Village Achabal, Sopore, Baramulla.”
Accordingly, the Lieutenant Governor hereby dismisses Dr. Nisar-Ul-Hassan, Assistant Professor (Medicine), SMHS Hospital, Srinagar S/o Ghulam Hassan R/o Village Achabal, Sopore, Baramulla from service, with immediate effect.
