Srinagar, April 05: In non-compliance of its orders, the High Court of Jammu & Kashmir and Ladakh issued a bailable warrant against Director Health Services, Kashmir (DHSK), to secure his presence before it.
A division bench comprising Justices Sanjeev Kumar and Puneet Gupta while issuing bailable warrant in the amount of Rs.10,000 for securing the presence of DHSK asked Senior Superintendent of Police, Srinagar to execute the warrant and produce the DHSK before it on April 17.
The court was hearing a contempt plea filed by Ghulam Nabi Dar seeking implementation of judgment passed directing the respondents to consider the representation of the petitioner for providing employment to his son in terms of the promise extended in relation to taking over his land for construction of Primary Health Centre (PHC) and pass appropriate orders thereon in accordance with law and communicate the decision so taken to the petitioner most expeditiously.
In a previous hearing the court had made clear that in case the judgment is not fully complied with in letter and spirit, the DHSK would appear in person on the next date of hearing.
The court noted that neither the compliance report is filed, nor the DHSK has come present. “He appears to be in complete defiance of orders passed by this court.”
Adding,”In this situation, this court is left with no option, but to secure the presence of Director Health Services, Kashmir, through bailable warrant in the amount of Rs. 10,000 to be executed by Senior Superintendent of Police, Srinagar.”
On December 14 last year, the bench had granted four weeks’ “last and final” opportunity to the respondents to file complete compliance of the judgment.
