Commissioner, Jammu Municipal Corporation, Rahul Yadav has said that the demolition of a House by Jammu Municipal Corporation at Saw Mill Road, Dashmesh Nagar, Digiana was undertaken by Jammu Municipal Corporation as per the High Court Verdict.

The house was raised by one Ramesh Chander Gupta s/o Durga Prasad Gupta, and the said person levelled allegation against JMC that it has forcibly demolished his house without serving any notice to him.

Responding to his allegation given in the media, the Commissioner, JMC stated that JMC had issued Notice under section 7(3) in the year 2009 and in response to which Ramesh Chander Gupta approached the Hon’ble Tribunal and in the year 2012 he lost the case from Hon’ble Tribunal and verdict was given in favour of Jammu Municipal Corporation.

The said Ramesh Chander Gupta filed an appeal against the verdict of Special Tribunal in the High Court and ultimately the verdict was given in favour of Jammu Municipal Corporation by the High Court after the 10 years.

The Commissioner, JMC further clarified that the demolition was undertaken on the basis of verdict of the High Court and the allegations levelled by Ramesh Chander Gupta are totally baseless and not based on facts.

Further he clarified that cost of demolition and debris removal is the responsibility of person who carried un-authorized construction and the same shall be recovered from him.
