Srinagar man convicted for forgery in Chemistry tender case

Srinagar, June 23: The Court of City Judge (Judicial Magistrate 1st Class) has convicted Saqib Faheem Kachroo S/o Mohammad Ashraf Kachroo R/o Bohlochipora, Soura, Srinagar, in case FIR No. 48/2004 u/S 511, 420, 468, 471, 201 RPC of P/S Crime Branch Kashmir.

According to the case details, the brief facts are that the Directorate of School Education Kashmir invited tenders for the purchase of science materials for chemistry subject from ISI/ISO certified manufacturers/dealers vide No. DSEK/Acctt/Science, Chemistry/18/1745 dated: November 14, 2003. After opening the tenders, it was found that one M/s Marinex Chemie, near Gole Masjid, Bohlochipora, Soura, Srinagar, a local SSI unit holder, had produced ISO-9000 certificate bearing No. OSC-9000 purportedly issued from Rotherdam, the Netherlands.

The certificate prima facie appeared to be fake, and the tenderer had produced the same with intent to cheat the department. Consequent upon the complaint, a preliminary enquiry was conducted wherein the allegations levelled had been prima facie established. Accordingly, Police Station Crime Branch Kashmir lodged FIR No. 48/2004 and started investigation. During the course of investigation, it was found that the accused person was involved in offences punishable under Sections 511, 420, 468, 471, and 201 of RPC. The charge-sheet was presented before the Hon’ble Court for judicial determination on July 22, 2008 and the charges under the aforementioned sections were framed against the accused Saqib Faheem Kachroo.

Upon conclusion of the trial, the Court sentenced the accused to simple imprisonment for two years and a fine of Rs. 5000/- under Section 420 RPC. The accused shall also undergo simple imprisonment for two years and a fine of Rs. 5000/- under Section 468 RPC. He shall also go for simple imprisonment for two years with a fine of Rs. 5000/- under Section 471 RPC, and for simple imprisonment of one year with a fine of Rs. 5000/- under Section 511 of RPC. The Court further ordered that in case of default in the payment of fine, the accused shall further suffer simple imprisonment for six months. All the sentences shall run concurrently.
