Outsiders eligible for reserved teaching posts in J&K universities: Govt

Says no review of policy planned ‘Domicile rules differ for teaching & non-teaching posts’

Srinagar, Apr 04: The government has informed the Legislative Assembly that candidates from outside Jammu and Kashmir are eligible for appointment against reserved category posts in teaching positions across the seven public universities in the Union Territory, while domicile restrictions apply strictly to non-teaching posts.

Replying to a question raised by MLA Sunil Bhardwaj, the Minister Incharge of the Higher Education Department stated that appointments to teaching faculty in the seven public universities are governed by the relevant regulations issued by the University Grants Commission (UGC), while the reservation policy is implemented in accordance with the Jammu & Kashmir Reservation Act, 2004, as amended pursuant to the Jammu & Kashmir Reorganization Act, 2019, read with the Jammu & Kashmir Reservation Rules, 2005, as amended from time to time.

The seven public universities include Kashmir University, Jammu University, Cluster University Jammu, Cluster University Srinagar, Shri Mata Vaishno Devi University (Kakryal, Katra), Baba Ghulam Shah Badshah University (Rajouri), and the Islamic University of Science and Technology (Awantipora).

However, for non-teaching posts, the policy differs significantly. The government clarified that only domiciles of Jammu and Kashmir are eligible to avail reservation benefits for such positions, in accordance with the UT's reservation laws and domicile rules.

According to the reply, for teaching posts, there is no explicit bar on candidates belonging to reserved categories from outside the Union Territory. Recruitment is carried out on an all-India basis in line with UGC norms, which emphasise merit and open competition.

The reply further revealed that both central universities, established under Acts of Parliament as central autonomous bodies, follow the reservation rules and guidelines prescribed from time to time by the UGC and the Department of Personnel and Training, Government of India, for appointments to teaching and non-teaching positions.

The government also stated that it has not examined the implications of allowing outside candidates to compete for reserved teaching posts on local employment opportunities, replying in the negative when asked whether such an assessment had been conducted.

On whether any review or rationalisation of the policy is being considered, the government said that at present, no specific proposal for review or rationalisation of the existing reservation and domicile-related norms in university-level appointments is under consideration in the Higher Education Department. "As and when any such proposal is received, the same shall be examined in light of the existing statutory position, constitutional parameters, alongside other relevant legal and policy considerations," the reply added.
