HC grants interim relief to J&K pensioners in commuted pension case

Srinagar, Nov 21: The J&K Accounts Pensioners Welfare Forum, under the aegis of the J&K Accounts Icons Group, has achieved a significant legal milestone for pensioners in the Union Territory (UT) of Jammu and Kashmir. The High Court of Jammu, Kashmir, and Ladakh, in an interim order dated October 30, 2024, has provided relief to pensioners regarding the recovery of the commuted portion of their pension.
All the pensioners of UT of Jammu and Kashmir are well aware that the J&K Accounts Pensioners Welfare Association had filed two litigations in the High Court of Jammu, Kashmir and Ladakh during May 2024 which include one Nissar Ahmad Khan V/S UT of J&K and the other Chandji V/S UT of J&K for stoppage of commuted portion of pension after a period of 10.8 years as against the stipulated period of 15 years as per the rules currently in vogue in the U.T.
“All the pensioners in general and the members of the forum in particular are informed that our efforts with the laborious efforts of advocate Mir Manzoor Ahmad have borne fruit. Special greetings to Mohammad Salim Zahid and Chandji Bhat for their untirely work due to which this has become possible,” the members of the forum said.
Accounts Pensioners Welfare Association have appealed the concerned authorities in the UT Government and also to the Accountant General to issue necessary instructions to the concerned Treasury Officers and Authorities of Jammu and Kashmir Bank to implement the orders of the High Court forthwith strictly as per High Court Order.
The additional demands include
Release of 3%DA w.e.f 01/07/2024, and Enhancement of fixed Medical Allowance from ₹300/ to ₹1,000 per month retrospectively with effect from 01/04/2020 strictly as has been granted to the pensioners of UT of Ladakh and Pensioners of Govt of India.
“All the pensioners are advised to remain united and follow the programmes of the Forum,”forum said.
