Srinagar Court Grants Interim Bail to Accused in Attempt to Murder Case

Srinagar, May 6: In a significant courtroom development, a Srinagar court has granted interim bail to accused Shahid Bashir Kanoo in FIR No. 64/2026 registered at Police Station Safa Kadal under Section 109 BNS (Attempt to Murder) and Section 126(2) BNS (Wrongful Restraint).

 

According to the police report submitted before the court, the case originated from a written complaint lodged on 29 April 2026 by Amir Qadir of Shalab Mohalla, Anchar Soura. The complainant alleged that while he was on his way to a tuition class, he was wrongfully intercepted at Eidgah by an electric auto driver bearing registration No. JK01BB7639.

 

 It was alleged that the accused, without provocation, abused the complainant and launched a violent assault using an iron/steel rod, causing a grievous head injury. The complainant was immediately shifted to SMHS Hospital, where he received four stitches on his head. Police further stated that additional blows were allegedly attempted but were prevented due to timely intervention by passersby.

 

The investigation report further stated that the weapon of offence and the vehicle used in the commission of the crime were recovered and seized through proper seizure memos. The scene of occurrence was examined, and a detailed site plan was prepared. Geo-tagging, videography, and photography were conducted through the E-Sakshya application, and statements of witnesses were recorded under Section 180 BNSS. Police also informed the court that custodial interrogation was considered necessary as the investigation remains at a crucial stage.

 

The relief came after an intense hearing where defence counsels Advocate Shahbaz Majid and Advocate Qazi Mohammad Athar mounted a compelling and meticulously structured defence. The legal team emphasized the accused’s clean antecedents and absence of motive, invoking the well-established principle of criminal jurisprudence that “bail is the rule and jail is the exception.” The court was assured that the accused would cooperate fully with the ongoing investigation.

 

The prosecution strongly opposed the plea, highlighting the seriousness and gravity of the allegations. However, after considering the case record and submissions from both sides, the court observed that the statutory bar against bail was not attracted and that the interests of justice could be safeguarded through stringent conditions.

 

The court granted interim bail till 15 May 2026, subject to furnishing personal and surety bonds of ₹50,000 each. The accused has been directed to cooperate with the investigating agency, refrain from tampering with evidence, and not leave the territorial jurisdiction without prior permission.

 

The court also directed the authorities at Central Jail Srinagar to release the accused upon completion of formalities, provided he is not required in any other case.
