Prematurely nominating MLAs unconstitutional & illegal: Bhardwaj

Jammu, Oct 7:Senior advocate and newly appointed Working President of Jammu and Kashmir Congress Mohinder Bhardwaj has said that any attempt at notifying the names of five nominated MLAs before the Assembly coming into being, will be grossly illegal and unconstitutional. Such a premature move will be open to Constitutional and judicial scrutiny.
Speaking at an interactive session with the lawyers fraternity at the Janipur court complex held to felicitate him on his appointment as the Congress Working President, he said any such political misadventure by the BJP-led Central government and the party backed Lt Governor’s administration will be fraught with serious consequences. It will be perceived as yet another step towards further usurping the Constitutional rights of people of Jammu and Kashmir after the August 5, 2019 Constitutional changes that robbed J&K of its statehood and demoted it to a Union Territory.
Bhardwaj said that the BJP strategists are trying to create a mirage that the party is going to form the government. The party’s move at prematurely starting the process of nominating MLAs only proves beyond any doubt that the BJP has already conceded defeat and that the National Conference-Congress is set to form the government comfortably. It is ironic that after dividing, decimating and demoting Jammu and Kashmir state, the BJP is once again playing an anti-people and anti-J&K game. “People have fully understood your game and have been pushed to a disastrous situation. They will not tolerate any further move aimed at undermining their existence and snatching their rights through such unconstitutional moves,” he added.
Thanking the lawyers community for felicitations, the three time president of the Jammu and Kashmir High Court Bar Association said he would always remain in the forefront in fighting for the cause of the Bar Association and its members.
Speaking on the occasion Mr. Gagan, Advocate said that it is for the first time in the recent past that the Congress has given a due representation to the lawyers fraternity by making Mr Bhardwaj as the Working President. Though belated but it is a welcome move.
These sentiments were also shared by other lawyers who spoke on the occasion.
