Ganderbal, Dec 11: In a decisive move aimed at curbing the rising incidents of road accidents, the District Magistrate of Ganderbal, Shyambir (IAS), has issued Order No.: 38 – DMG of 2023 on December 9, 2023.
Citing a significant surge in traffic accidents involving two-wheeler riders without helmets, the order highlights the alarming rates of injuries and fatalities resulting from this negligence. The District Administration, in collaboration with law enforcement agencies, has intensified efforts to address this issue, complementing the existing traffic rules enforced by the Police and Transport Department.
Accoding to an order The Motor Vehicle Act, 1988, already deems riding a two-wheeler without a helmet as a serious traffic offense. Petrol pump owners have previously been cautioned against selling fuel to riders without helmets. However, the latest order takes a more stringent stance on this matter.
Under the authority vested by section 144 Cr. PC 1973, District Magistrate Shyambir mandates the following actions:
No petrol station in District Ganderbal is permitted to sell fuel to two-wheeler riders without helmets. Petrol station owners are instructed to install CCTV cameras capturing clear footage of buyers. Executive Magistrates are authorized to review this footage and report violators to the District Magistrate.
Petrol stations found selling fuel to helmetless riders will be held personally responsible and face legal consequences. Tehsildars are tasked with ensuring the dissemination of this order to all petrol stations within their jurisdictions, The order further reads.
Any violations of this order will be addressed in accordance with section 188 of the Indian Penal Code. The order comes into immediate effect, prioritizing the security and safety of individuals on the roads. District Magistrate Shyambir emphasizes the collective responsibility in adhering to this directive, seeking cooperation from both petrol station owners and two-wheeler riders to enhance road safety in the district.
