High Court on Tuesday directed the State government to move an appropriate application seeking expeditious disposal of all Land Acquisition cases to ensure completion of Dalgate-Hazratbal road widening project without any further delay.
Hearing a Public Interest Litigation (PIL) over the ongoing road widening programme from Dalgate to Hazratbal, Srinagar the division bench of Chief Justice Gita Mittal and Justice Sanjeev Kumar directed the concerned authorities to file a status report with regard to the filing of applications and the same shall be placed before the Court by next date of hearing.
The Court while perusing the report dated 19 November 2018 said a reference has been made to several pending cases before the Courts. “However, a majority of the cases relate to the amount of compensation,” the Court said.
The court also pointed out that in few cases, there appear to be disputes between or among the owners, family disputes and partnership disputes pending before the courts. In other cases, orders of status-quo have been set out.
The road widening program commenced way back in the year 2002.
The court observed that it appears that the road widening has been affected only to the extent of land was acquired by the authorities.
The litigation has been filed by J&K People’s Forum through advocate Yawar Khan.
