Conduct KCCI elections within one month: HC

Tells DC to oversee process, nominates caretaker committee to KCCI

Srinagar: The Jammu and Kashmir High Court has formed a six-member caretaker committee for the Kashmir Chamber of Commerce and Industries (KCCI) and directed that fresh elections for the Chamber should be held within one month.



The court has also nominated Deputy Commissioner Srinagar and six members to oversee the election process.



The Bench of Justice Vinod Chatterji Koul directed that two members namely Farooq  Ahmin Chadino and Manzoor Ahmad Pakhtoom will work as caretakers of KCCI till elections are over on ending April.



“They shall act as caretakers of KCCI, to operate bank account of the chamber maintained in J&K Bank Branch Residency Road Srinagar, only to the extent of making payment of salary to employees/staff of KCCI and for payment of electricity/ telephone bills/charges,” it said.



The judge also asked the caretaker body and the bank authorities to apprise the court about the payments and transactions of the KCCI bank account.  

 

“The xerox copies of payments on account of salary to employees/ 

the staff of KCCI and electricity/telephone bills/charges shall be submitted by the persons selected,” he said. 

“Manager, J&K Bank, Residency Road shall submit the details/statement of aforementioned accounts by the end of April 2021, detailing out there in the amount lying and withdrawn by afore-named persons from the above accounts,” the order said.  

 

The court said the six persons whose names were proposed by the opposite factions shall form and function as a Committee for conducting elections of KCCI as also for the 

positions/office bearers of KCCI, viz. President, Senior Vice President, Junior Vice President, Secretary-General, Joint Secretary General and Treasurer as prescribed under Memo of KCCI. 

“All the exercise in this regard shall be undertaken and concluded within one month and by the  end of April 2021, all the positions/office bearers of KCCI shall be elected.”.  


“The elections process shall be supervised by Deputy Commissioner, Srinagar. He shall and is free to take all steps for the conduct of elections of KCCI. And while conducting the elections shall follow all the SOPs issued by the Government from time-to-time with regard to the COVID-19 pandemic and ensure its conclusion by end of April 2021, and report accordingly,” the court said.
