Pulwama man gets two years imprisonment for rash, negligent driving

Pampore, July 01: The court of Judicial Magistrate Pampore sentenced a man for two years imprisonment for having hit a pedestrian in rash and negligent driving in Patal Bagh area of South Kashmir’s Pulwama district.
The case history reveals that an FIR 137/2015 was registered against Mohammad Yusuf Malik, a resident of Zasoo, Pulwama under section 279, 304 A RPC.
It adds that he was accused for rash and negligent driving and was alleged for having hit a pedestrian, Abdul Bhat near Patal Bagh in Pulwama. The case reveals that Bhat later succumbed to his injuries.
The case file further states that the accused denied allegations and claimed trial. The accused was represented by his counsel and the state by APP (additional public prosecutor).
The court heard both the counsel and the APP after which it pronounced a two-year imprisonment for the accused.  
The court observed that there is enough material on the record to prove that the accused while driving his car bearing registration number JK13C 1527 rashly and negligently hit an old pedestrian.
“Prosecution has been able to successfully prove the contents of Sec 304 A/ 279 RPC against the accused beyond any reasonable shadow of doubt. As such the accused is convicted for the offence under Sec 304-A/279 RPC and is sentenced to imprisonment for 2 years for the offence under Sec 304A RPC and 2 months for the offence under Sec 279 RPC. The sentences shall run concurrently,” the judgment reads.
