Srinagar, June 3: CPI (M) leader Mohamad Yousuf Tarigami, Friday said that despite the clear directions from High Court to return the mortal remains of Amir Latief Magray, the third civilian killed in controversial Hyderpora encounter last year, to his family, the body of the victim is yet to be exhumed.
It is very unfortunate that the administration has not carried out the exhumation even after a week-long hiatus, he said.
Right to decent burial is a fundamental right guaranteed by the constitution and every dead body deserves a decent burial, he said adding, it is a constitutional infraction to deny the return of mortal remains to one's legal heirs for performing the last rites. It also sans reason as how a dead body could pose a security threat.
CPI (M) has always opposed the administrative move of not returning the bodies of slain to their families. CPI (M) enjoins the administration to exhume the body of Magray without any further delay and return it to his family for re-burial.
